PSHP Adrem Law is pleased to share that the Indonesia chapter of the newly published Lexology Panoramic: Loan and Secured Financing 2026 has been contributed by our Partner, Avinash Panjabi, together with Counsel Tania Faramutia and Associates Mery Enjelica Stephany and Einar Fausta Hertianto.
The chapter provides a comprehensive overview of Indonesia’s regulatory framework concerning the provisions of loans, including key laws, policies, and regulatory authorities governing financing. The chapter discusses banking hedging and ratio requirements, notification obligations, and the roles of key authorities such as the Financial Services Authority (OJK), and the Bank of Indonesia.
Additionally, the chapter examines key aspects of secured financing transactions in Indonesia, including the creation and perfection of security interests, enforcement mechanisms, priority of claims, and considerations relating to guarantees, collateral arrangements, and insolvency proceedings. It also discusses practical issues commonly encountered in cross-border financing transactions and syndicated lending structures.
We conclude the chapter with an analysis of recent legal and regulatory developments affecting the Indonesian financing market, including evolving regulatory approaches by OJK and Bank Indonesia, developments in sustainable and transition financing, and broader trends shaping lending and secured transactions in Indonesia’s dynamic economic landscape.
